Will Obama flip flop on gay marriage?

(Boston, Massachusetts) Fears are mounting that the Obama administration is about to flip-flop on its opposition to the Federal Defense of Marriage Act.
Last March, a federal lawsuit was filed in Boston challenging the law which bars the federal government from recognizing same-sex marriage. The Justice Department has until June 22 to respond to the lawsuit. So far there has been no comment from either the department or the White House.The Department of Justice typically defends laws passed by Congress. But during the election campaign, then-candidate Obama pledged to overturn the ban.
A grassroots online campaign called Equal Rep has begun to pressure the administration to keep his campaign promise by asking Attorney General Eric Holder “not to defend this unconstitutional law.” 365gay blogger Emma Ruby-Sachs helped craft the legal memo to Obama, which states in part, “The President reserves the right to refuse to defend an unconstitutional statute. Section 3 of the DOMA is clearly unconstitutional in that it denies married same-sex couples economic benefits granted to heterosexual married couples from the same state without providing a rational basis for this discrimination. ”
The Web site includes a cut-out mailer urging the president not to flip flop on the issue.
Support is slowly growing in Congress for repeal of the 1998 law, but a bill has yet to be filed in either the House or the Senate. In the meantime, the lawsuit challenging DOMA appears likely to proceed.
The lawsuit was filed by Gay & Lesbian Advocates & Defenders, the group that brought a successful legal challenge leading to Massachusetts becoming the first state in the nation to legalize gay marriage in 2004. GLAD brought a similar successful suit in Connecticut.
GLAD represents eight married couples and three surviving spouses from Massachusetts who have been denied federal legal protections available to spouses. The lawsuit alleges that the act discriminates against gay couples and is unconstitutional because it denies them access to federal benefits that other married couples receive, such as pensions and health insurance.
Among the plaintiffs is Dean Hara, the widower of former U.S. Rep. Gerry Studds, the first openly gay member of the House of Representatives.
Another plaintiff is Mary Ritchie, a Massachusetts State Police trooper who has been married for almost five years and has two children. But when she files her federal income tax return, she’s not allowed to check the “married filing jointly” box as a result of DOMA.
In Ritchie’s case, she and her spouse say they have paid nearly $15,000 more in taxes than they would have if they had been able to file joint returns.
The Defense of Marriage Act, or DOMA, was enacted by Congress in 1996 when it appeared Hawaii would soon legalize same-sex marriage and opponents worried that other states would be forced to recognize such marriages.
The GLAD lawsuit challenges only the portion of the law that prevents the federal government from affording Social Security and other benefits to same-sex couples.
Among those in Congress calling for repeal of the act is Sen. Tom Harkin (D-Iowa), one of the original supporters of the measure. Harkin said earlier this month that he has changed his mind on same-sex marriage.
”We all grow as we get older, we learn things, we become more sensitive to people and people’s lives,” Harkin told Iowa public television. ”The more I’ve looked at that, I’ve grown to think differently about how we should live. I guess I’ve got to the point of live and let live.”
Even if the bill is filed this session, it may find difficulty getting to a vote. In addition to opposition from Republicans and number of conservative Democrats, mainly from Bible belt states Speaker Nancy Pelosi (D-Calif.) seems in no rush to advance repeal.
This month Pelosi suggested there may not be enough votes yet for repeal.
In a recent Quinnipiac University public opinion poll, voters showed narrow support maintaining DOMA – 50-44 percent.




Honestly guys, I don’t know why you all are dissing Obama for right now. He’s only been in office for a short period of time after his inauguration and already, you guys look for someone to blame for your “mistreatment”. Sometimes, it kinda makes me ashamed to say that I am gay from all the whining and the fussing that comes from all the people that live in America and Canada. “Where’s our rights?” “Why can’t we marry?” “We want it now!” I’m just thankful that I am not dead right now, as that what would have happened in the past ‘or’ living in some other countries today.
Obama may not be living up to his promises that he said about the gblt community right now, but give it time. As much as I hate to say it, the glbt “MINORITY” (key word) group is a far-cry from the Democrats plan right now with dealing with a crashing and job-less economy, environmental pressues, and even war issues. So please, be considerate to the government. Give it time… and our chance to have rights will come.
Seems like it is getting harder and harder to tell Dems from Rep. Tell you what if the Gay and Lesbians in America have not the right to the same as other couples why do we have to pay taxes? 4 years may pass faster than Obama may think. Lets hope the Dems. grow a back bone soon.
Obama is a politician and will go with the political tide. I don’t think he will flip flop on DOMA, he’ll just remain silent on it. A repeal of DOMA will not happen in this still conservative Democratic congress. A super-majority of 60 votes means nothing when you have red-state democratic senators voting against progress.
Obama is more worried about his right flank than he is about the gay community. He “knows” that he has our vote regardless. I think it is time we protest Obama, otherwise, it will be status quo. We need to stop being “nice little queers”!

I don’t think he’ll flip flop on DOMA, I don’t think it’s a top priority tho.. He had a goal. We should work on getting more gays wanting to marry..
Yeah, Tom Harkin, now is the time to redeem yourself for DOMA though your excuse for “growing older” and “seeing things differently”(you were 57 in 1996 when you supported DOMA)is a poor one. Even if it is honest. Tolerance should be taught and learned from birth rather than 70. But better late than never, eh?
As though I believe the prez is an empathetic person, he’s also a political animal and will guage congressional zeitgeist before dissenting DOMA (or don’t ask etc.)Despite the Quinnipiac poll, there are silver linings in Maine, New Hampshire, Iowa and NY to go with California’s PROP 8 black cloud and the narrowing margin of public pro and con. Same sex spouses/partners of 9/11 victims had to fight to receive benefits The Red Cross adopted new criteria to include same sex domestic partners for all releif efforts. And NY State assembly followed up with similar recognition and dispersal of benefits. So fighting the good fight takes time, money and patience. But we are getting to that place slowly but surely.

I suggested (or stated) earlier that you cannot trust Obama on any gay issue. My suggestion is do not hold your breath. Lobby lobby lobby and hope it goes somewhere. From an article I read he has made up his mind on a lot of things and if he made up his mind against any (all?) gay issues you will hear soon.
I don’t know how much longer we can accept the Democrats ignoring our problems in a supposed democratic society.
Mike get real. Nothing will happen, nothing will change, especially in this first four years. Then doubtful. They say enought to get our votes and get our money, then we are back to being a liability. The more things “change” the more they stay the same.
