KStarr and his “We will not mince words. The attorney general is inviting this court to declare a constitutional revolution,”
....just more of the same. Continuing to attempt to portray the bigots as the 'victims.' ...and now a threat of revolution! I do hope the Court spanks his hands with a definitive ruling!..
after all how much more sinister can he be.

“They argued that nothing in the language of Proposition 8, nor the ballot arguments submitted by Protect Marriage, made it clear the gay marriage ban was designed to apply retroactively.”

It looks like they were right. I'm attaching the Attorney General's official November 4 summary of the proposed amendment, the text, and links to both. There's no indication that the amendment would apply retroactively.

PROP 8
ELIMINATES RIGHT OF SAME–SEX COUPLES TO MARRY. INITIATIVE CONSTITUTIONAL AMENDMENT.

OFFICIAL TITLE AND SUMMARY
PREPARED BY THE ATTORNEY GENERAL

ELIMINATES RIGHT OF SAME–SEX COUPLES TO MARRY. INITIATIVE CONSTITUTIONAL AMENDMENT.
Changes the California Constitution to eliminate the right of same-sex couples to marry in California.
Provides that only marriage between a man and a woman is valid or recognized in California.
Summary of Legislative Analyst’s Estimate of Net State and Local Government Fiscal Impact:
Over the next few years, potential revenue loss, mainly from sales taxes, totaling in the several tens of millions of dollars, to state and local governments.
In the long run, likely little fiscal impact on state and local governments.

PROPOSITION 8
This initiative measure is submitted to the people in accordance with the
provisions of Article II, Section 8, of the California Constitution.
This initiative measure expressly amends the California Constitution by
adding a section thereto; therefore, new provisions proposed to be added are
printed in italic type to indicate that they are new.
SECTION 1. Title
This measure shall be known and may be cited as the “California Marriage
Protection Act.”
SECTION 2. Section 7.5 is added to Article I of the California Constitution,
to read:
SEC. 7.5. Only marriage between a man and a woman is valid or recognized
in California. [Last sentence italicized]

I'm pretty sure in the description of the ballot measure I received that it stated it would apply to marriages regardless of where or WHEN they occurred.

"Kuhle also said that state support of same-sex marriage would damage traditional marriage, arguing that it would indicate to future generations that marriage is no longer about procreation."
If this is true, then it should be required to prove that both parties applying for marriage are able to reproduce and a child must be produced with-in 18 months or the marriage will be invalidated. Those unable to reproduce shall be denied said right as dictated by traditional marriage.
Kind of different when you throw their own words back at them.

If California invalidates all the same sex marriages, then all those couples should ask for their money back for the licenses. Can California really afford to refund all the monies that it received. How about the lawsuits for all the ceremonies that were held. How about suing the group that is saying that all same sex marriages should be invalidated for all the same monies that were spent on all the ceremonies. This same type of idea broke a major KKK clan when they couldn't pay a claim that they lost. Just an idea for people to consider.
