		<description>I&#039;m confident that Obama&#039;s Supreme Court pick will have minimal impact on shifting the court in any direction.  We need one of the &quot;just say no&quot; justices to step down for that to happen.  Given the age of Alito, Thomas and Scalia, it is unlikely Obama will get a chance to replace any of them (even if he is elected to a second term).  Best we can hope for is that one of &quot;no&quot; guys retires due to health issues.

What is more likely is that Obama will shore up (age wise) the liberal wing of the SCOTUS. Stevens is getting up there (89) and is likely to retire within Obama&#039;s first term.  Ginsberg is relatively young but has had health issues and is likely to retire within Obama&#039;s first term.

Next in line by age is Scalia and given his right wing slant on every case, he&#039;s not likely to retire under an Obama administration.  He&#039;ll probably try to hold out until a Republican gets back in office.  (Let&#039;s hope that is a looooong time.)

Although it was rarely mentioned in this election cycle, this is one of the major factors in Obama winning.  Could you imagine how far our causes would be set back if McCain were elected?  It&#039;d be another generation before we&#039;d even have a chance at success at the Supreme Court level.  Unfortunately, with Gore&#039;s failure to take the Presidency (or failure to win at the Supreme Court), we were already set back by at least a decade by the nomination of Alito and Roberts.

It looks like the best we can hope for in the near term is continuation of the status quo on the Supreme Court.

In the mean time we have plenty to do to educate and make incremental progress where we can at the state and federal level on equal marriage, non-discrimination, hate crimes, DADT, immigration and DOMA.

We&#039;ll need a favorable SCOTUS in the future once legal challenges to these laws takes place.</description>
