I’m sorry but I have to agree with their ruling. They’re not stating they don’t feel those individuals deserve protection under the law. They’re saying the manner in which it was passed was not right.
If you want to blame someone, blame the lawmakers who tacked it onto an unrelated bill to have it passed. Complain to them and have them do their jobs correctly next time.

This is incredibly sad. One would hope that a state as lovely as PA would realize what the State Supreme Ct has done as wrong, and get it overturned. “Repent America” is about as Christian as freddie phelps and his gulag.

if you go to Repent America, their claim is that they found the content of the bill unconstitutional though. contrary to the actual reason it was struck down. Go to their website and look at their story.

I hate to see a group like Repent America get a legal victory when I know their motives are homophobic. But I have no problem with the ruling itself, in fact I think it is a wise ruling. The ruling did not address the content of the hate crime law, and did not in any sense rule that hate crime laws are unconstitutional.

The ruling just said that the law had to pass on its own merits, and not by being attached to an unrelated law that was going to pass. It ruled against a kind of deviousness. We should not stoop to rely on such strategies, and we don’t need to. The legislature is irresponsible in not passing the law properly.

I hope Repent America and the Pennsylvania Supreme Court enjoys their one year of “legal” gay bashing. Because Congress is going to pass the Matthew Shepard Act next year. President Obama will sign it into law. That will make all of this moot. Moreover, the U.S. Supreme Court has always held that federal hate crime laws are constitutional.
