Parents Of Slain Gay Man Seek $20M From Police

(San Diego, Calif.) The parents of a gay man shot to death by police during a gay pride event in San Diego have filed two claims seeking $20 million dollars from the San Diego Harbor Police.
Harbor Police were notified by the operators of the charter boat and Hirschfield was rescued but reportedly began fighting with officers who pulled him onto their boat.
He allegedly grabbed a Taser from one officer and struck him in the face. Police said he then attempted to take the officer’s handgun.
As the two struggled a second officer shot Hirshfield. He was pronounced dead by paramedics when the police boat docked.
The claims were made by Alan and Nicole Hirschfield in what is the first step toward filing a lawsuit.
The attorney representing Hirschfield’s parents, Brian Claypool, earlier this week accused Harbor Police Chief Kirk Sanfilippo of homophobia. The chief has declined to comment on Claypool’s allegations and the claim filed on behalf of the parents does not mention homophobia.
It accuses the officers involved in the shooting of killing Hirschfield without justification.
Both officers have been placed on paid administrative leave while the San Diego Police Department conducts an investigation.
In an interview with the San Diego Tribune Claypool said that the notice of claim is the only way to get the facts surrounding the shooting.
“Then we can gather, through discovery, all of the physical evidence and witness statements from the San Diego police,” he told the paper.
“If we don’t file a lawsuit, we’ll never be able to reconstruct the shooting.”





All police are currupt.
Ok they are in a boat,probably a relativly small one with at best an 8 by 10 open space. One man is struggleing with an Officer. he aleggedly grabs for the Officers gun. Ergo he will probably be shot in the back or at best in the side by the other officer.Sorry gang, there is little time to react, and if there is a deadly weapon involved, you have to act now. I’m not a police officer or an appologist, but a combative person in close space, is the equivelent of knives in a phone booth.
If one officer had a taser, the others probably had them too. Why didn’t they use that option instead of a gun. Even if Steve was in a drug-induced paranoid panic, the police were in a position to make a non-lethal choice. Don’t they get training in dealing with atypical behavior?
Kerstin, some of the reasons that the family could be have filed suit were because their unarmed son did not have any wounds that were consistant with the Harbor Patrol’s story that he had attacked them or because he had been shot in the back–which would have indicated that he was not threatening them. Or perhaps it was because the Harbor Patrol did not report the incident until much later: giving them the opportunity to concoct a cover story.
Not sure what they are sueing for as, according to the article, he attacked officers and per the other comments he was on drugs. 20mm is frivolous.

I wanted to clarify my last post. I was not making an assumption that he was on drugs – it is just one possibility of many. I am not making any accusations; just pondering possibilities.
Whatever his sexuality the point of the matter is that he is dead. Was it a result of him freaking out because he thought he was going to die, possibly high on drugs mixed with the threat of death, the cops being homophobic because they thought he was gay or simply a horrible and unfortunate situation of a gun going off in the confusion of his rescue? – Hopefully, the discovery will bring out the truth of what happened.
So, what are you saying…that straight Hirschfield was on a gay cruise to glom drugs?
Steve H was not gay, not for pay or his personal life. You should change the heading. He was a nice guy who had some control problems around drugs (and he was dancing at a circuit party on a boat). This site is perpetuating he was gay.
