Why wouldn't this order also apply to gay men using a surrogate when one of the men is the bio-dad? It seems to me to be the same situation...

I for one am quite happy. Some people fail to understand that change is a slow process. It is not going to happen over night. Even though the non-biological parent may have to follow and adoption process at least we [lesbians]can put our names on the birth certificate.
I know that we deserve more and that there are still things wrong with that, but like I said before we will not have all the right changes over night even thouh we would like too.

Non-bio parents need to take steps to protect their parental rights, including either an adoption or obtain a judgment of parentage. Adoption is not the sole means of protecting rights.

Be aware that the birth certificate does not necessarily imply parental rights. Non-bio parents still need to do the adoption to be a legal parent, at least outside the state and possibly inside.
