There really isn't any legal ambiguity here. As far as I know, New York law recognizes marriages performed in a certain list of other jurisdictions. Unless the law has a special exception for same-sex marriages (which it does not), failure to recognize same-sex marriages performed in places where it is legal would violate New York state law.
