Fla. school sued: Refused gay-straight club


(Jacksonville, Florida) Two Florida high school students on Tuesday sued their school board because they were not allowed to form a club that promotes the tolerance of gays.The American Civil Liberties Union of Florida filed the suit Tuesday in federal court on behalf of Yulee High School students Hannah Page, a freshman, and Jacob Brock, a junior.

The lawsuit claims violations of the First Amendment and the Federal Equal Access Act. The act requires schools to grant access and recognition to a Gay-Straight Alliance and other groups if the school allows any extracurricular group to meet on campus, said ACLU attorney Robert F. Rosenwald.

The lawsuit seeks a preliminary injunction to allow the club to meet at Yulee High while the case makes it way to trial.

Page said the group just wants to meet like others do.

“We just want the club so that straight and gay kids can get together to talk about harassment and discrimination against gay kids in an open environment. The school is discriminating against us and that’s exactly the kind of thing we want to prevent,” she said.

John L. Ruis, the school district’s superintendent, said in a letter to Rosenwald that “a club highlighting sexual orientations will not be permitted as it would violate school board policy.” The Nassau County School Board was served with the lawsuit.

The ACLU recently won a similar case in Okeechobee. A judge there ruled schools must provide for the well-being of gay students and cannot discriminate against the Gay-Straight Alliance.

Rosenwald said the Okeechobee County School Board paid $326,000 in attorneys fees in the case.

Yulee is about 25 miles north of Jacksonville.

    • I live in Florida. On all the news channels all I hear about is how much the school budgets are going to be short. There is talk about eliminating sports and all extra-cirricular activaties. If this is happening in this particular school district then there is no problem. No clubs or meetings will be held anyway. But if this school district is lucky enough to continue with these activaties then the G-S Club should be allowed to meet. Can that school district actually afford to really pay any kind of settlement? Or are they really willing to screw the children that they are suppose to instruct. Either way it will be the students (and even the teachers) that will be getting the shaft.

    • I wonder if the ACLU is asking to get their costs recovered from the Okeechobee case. If the ACLU were to be able to recover costs and if their costs were similar to the school’s costs, the school’s bigotry will end up costing them well over a half a million dollars.

    • It seems that there’s no doubt that these homophobic school administrators know that they’re likely to lose each of these lawsuits, given that I can’t think of one example in the nation where the bigots have won. It really is just their attempt to turn this into a war of attrition. Slash and burn, basically. Trying to exhaust the resources and stamina of their enemies, those goddam homyosekshurals. They are angry, and don’t care who gets hurt in the process as long as they go down fighting. It’s as though they’re afraid their communities will turn on them if they don’t put up a fight. And maybe they would, probably. But we’ll surely win this one, and every other one that comes up. We have tons of case law and precedent. The law is pretty clear on this.
