Decision on Florida’s gay adoption ban imminent

Florida’s gays and lesbians can expect a decision by the U.S. court of appeals on the constitutionality of the state’s gay adoption ban soon, the Orlando Sentinel reports.

Martin Gill, a flight attendant who, with his partner, cares for two foster children, brought the case to court trying to overturn the Florida Legislature’s 1977 ban. Florida is the only state that flatly bans gays and lesbians from adopting children; same-sex couples caring for foster children is permissible.

“For the first time in the 30 years of the ban, a court had heard all the scientific evidence on how kids do when they are raised in gay families, and came to the conclusion that there’s no rational basis to believe that kids do better with straight families than gay people,” Robert Rosenwald, Gill’s American Civil Liberties Union attorney, told the newspaper. “The appeals court should uphold the Lederman decision because it is based on evidence, scientific evidence that is largely undisputed by the state.”

Decisions by the U.S. Court of Appeals, 3rd Circuit, are posted between 10:30 and 10:45 a.m. on the court’s Web site on Wednesdays, according to the story.

    • OH FLORIDAAAA!!! why don’t you first find out how many gay couples actually produced these “homeless” children, went on welfare, collect food stamps and or unemployment, then negelated and abused the children before you open your mouth and say that we are not fit parents and families for your heterosexual population without brains.

    • The Sentinel got its facts wrong. This is not a federal case, but a state case. The U.S. Court of Appeals for the 3rd Circuit covers Pennsylvania, New Jersey and Delaware, and is based in Philadelphia. Florida is in the 11th Circuit, which has already upheld Florida’s ban under the federal constitution. This case is probably pending before the Florida Third District Court of Appeal (http://www.3dca.flcourts.org/), which is located in Miami.

      While a win on this case could certainly be great, it would have little impact outside of Florida, since it is in a Florida court, which is ruling on Florida law.
