Battle over child visitation rages on despite rulings

(Winchester, Virginia) A woman attempting to keep her former partner from having visitation rights to her daughter is refusing to accept court rulings in two states and the refusal of the US Supreme Court to become involved.
Lisa Miller has filed another appeal in the case. This time her attorneys argue that the state of Virginia cannot enforce the federal Parental Kidnapping Prevention Act, which says custody orders of one state must be enforced in other states.Miller, who says she is no longer a lesbian, is represented by the Liberty Counsel which frequently takes up anti-gay cases.
Her brief to the Virginia Court of Appeals states that her former partner, Janet Jenkins, has no rights because of the Virginia constitutional amendment that bars same-sex marriage and civil unions.
Jenkins is represented by the American Civil Liberties Union of Virginia which has asked for the appeal to be tossed out, arguing that Miller is offering nothing new.
At the center of the battle is a six-year old girl named Isabelle who was conceived through artificial insemination to Miller.
At the time Miller was in a relationship with Jenkins which had been formalized by a civil union in Vermont where they resided.
When the relationship between the two women soured and they split up, a judge in Vermont gave Jenkins temporary visitation rights with the child.
Miller then fled with her daughter to Virginia which has some of the most anti-gay legislation in the country. She then declared she was no longer a lesbian, hired the conservative Christian law firm Liberty Counsel and went to court in Virginia seeking sole custody of the child.
Miller argued that since gay unions are banned in Virginia she was not obligated to abide by the Vermont ruling.
Jenkins fought the application on the grounds that the case was already before the court in Vermont.
In 2007, the Vermont Supreme Court unanimously concluded that “under well-established laws designed to protect children and families” the Vermont Family Court properly ordered visitation between Janet and her daughter.
Liberty Counsel appealed to the US Supreme Court, which refused to hear the case. But the battle did not end there.
The case then returned to the Virginia Supreme Court which ruled in June that the Vermont high court’s ruling should stand. The court cited the federal Parental Kidnapping Prevention Act, which says custody orders of one state must be enforced in other states.
But Miller returned to a lower court in Virginia requesting a halt in the visitation order.
Frederick County Circuit Judge John Prosser dismissed the application saying the courts had already ruled in Miller presented no new evidence to reopen the case.
Liberty Counsel appealed again to the Virginia Supreme Court which refused to hear the case.
Liberty Counsel then attempted to return to the US Supreme Court arguing the Virginia high court improperly ignored a state law and the state constitutional amendment.
In January, a Vermont Family Court judge ruled that Jenkins must be given five weeks of custody in the summer and warned Miller that if she did not comply she risks losing custody of the girl.




Lisa Miller is, like Siobhan LaPiana in an Ohio court case, a woman demonstrating that she is an unfit parent. Anybody who devotes so much energy to keep children away from another parent–when there’s no argument of abuse or neglect–is a person who is insufficiently focused on the child’s needs. Miller probably doesn’t even see that she’s caused immeasurable damage to her relationship with her daughter. And for what–because she’s too immature to deal with the consequences of her own actions? What a messed-up wench.
Jerry Falwell may be dead but his hate machine is alive and well. Liberty Counsel has made this their fight and I’m willing to bet that it is pro bono for Miller. What a judge should do is find these lawyers to be in contempt of court for ignoring the final rulings. A few days in a county jail with their lily white asses up in the air……
I’m not a lawyer, but can the courts in Virginia or Vermont refer Miller to a DA to have her charged with kidnapping?
Janet Jenkins should be VERY careful because I think that this “christian” woman will kidnap the little girl just before the visitian is about to begin. Lisa Miller will run to the christian underground railroad to prevent their daughter from seeing her other mother again. Miller is ignoring the laws of the land. These same laws that some christians want The Ten Commandments to be placed either outside or inside a court of law. This placement is suppose to be because the first laws were the commandments. So lets ignore The Ten Commandments and every other law if you are christian or whatever.
As a co adoptive parent, I see what Lisa Miller is doing is 100% WRONG. Lisa Millers brand of Got Religion is just Bad. Becuase she thinks God is on her side she can and will break the law. She really needs to grow up. I feel so sorry for the former spouse and especially the kid. Two viewpoints on life would be good for the kid.

Wow… so first things first… full faith and credit clause in addition to the kidnapping act gives the other mother a lot of power. I think that this whole situation will work in the favor of homosexuals. This is a perfect example of why full faith and credit is so important. People can’t just up and move to a state because they don’t like what was said. Plus the FEDERAL kidnapping law trumps any state law. I wonder what happened to Miller to have her turn into a witch? Does she plan on eating the child?
I think she, and her lawyer buddies, are angling for her to be a martyr of the Big Bad “Gay Agenda”. Whether she thinks so or not, she is maliciously using her child as a pawn in this matter, and I think that’s despicable. She’s going to end up losing her child due to concerns over her fitness to be a parent, and then the Religious Right will have fodder for their “The Gays Are Stealing Our Children!!” nonsense.
Any decent lawyer would tell this woman that she has had her day in court and lost. Not only has the State Supreme Court ruled, but the US Supreme Court has refused to hear anything further. Unfortunatly, Liberty Counsel is using her as much as she is using this child. And to what end. For this child to grow up knowing that her mother kept her from another parental figure who loves her so much that she continues to fight for the right to spend 5 weeks with her every year? What a testimony of the love of a parent for a child. She should lose custody of this child. What she is doing, what she is allowing Liberty Counsel to put her daughter through amounts to nothing less than child abuse.
this is just like the Energizer bunny – it is never ending. I guess the folks at Liberty Counsel just don’t have much else to do. Shame the girl is in the middle. You’d think the “Christian” thing to do would be to comply for the sake of the child.
They should take the girl from Miller. What hell this woman is putting her kid through out of pure hate and vengence, and the court should not allow it to continue. She needs to suck up the fact she chose the wrong person to have a kid with, like so many do, and tolerate the visits. The kid will turn 18 soon enough and she will kick herself for spending all that time fighting her ex.
On the “upside” of the hate, she’s making the lawyers rich.
