Vanasco: Who’s next on the Supreme Court?

The Daily Beast has the top contenders (though of course, no one actually knows). The Beast names Eric Holder, Diane Wood, Elena Kagan, Cass Sunstein,

I’d love the next choice to be Cass Sunstein (a well-regarded Constitutional law scholar and creative thinker who can explain law to the masses – as well as being just a nice guy), who I’ve personally found to be very gay friendly; or Judge Diane Wood, who is likewise a champion of our rights.

And oh, we’re going to need champions. Obama’s next Supreme Court won’t change the balance – we’d just be exchanging a liberal for a liberal – but the next court appointment is likely to rule on DOMA and DADT.  We need them to start off on our side.

Both Sunstein and Wood are University of Chicago Law School tested, which means they’ve honed their arguments against the best conservative minds in the country – which would be good for us, I think.

But what do I really think is going to happen? I’d say look out for Eric Holder, the first African-American attorney general, or some African-American female. We really do need more diversity on the Court, and Obama is the man to find it.

    • Hm…,well he had been criticized by the Hispanic community for not doing anything/enough for them, so he threw them the Sotomayor bone. Lord knows his gay vote base is even MORE angry and dissatisfied with him.

      Perhaps he’ll throw us the bone of the first gay man or woman on the court. I’d be happy with that. It would be great symbolically, while also making us more “real” to the conservatives on the bench.

      At one time, I would have had no reservations about Obama doing this. However, he has shown himself to be VERY easily cowered by the over the top, melodramatic, orchestrated hissy fits of his foes on the right. They never did and never would vote for him, so I’m not sure why he seems to struggle with upsetting them, but he does.

      Where is that “take no prisoners” attitude that he displayed in the campaign? You’ve GOT TO fight like a ruthless, cold hearted bitch against the right, because that’s how THEY fight.

      Instead, we’ve had months of Mr. I’m a nice, soft spoken intellectual who doesn’t want to rock the boat and make some people angry at me. Yes. He’s setting himself up to be the next Carter. America says they want nice, but they don’t respect a pussy. That’s why they replaced Carters nice with a man with some backbone!

      I could vomit!

    • If Obama is going for diversity, he will pick someone who matches all of these criteria:

      A. Female
      B. Non-Catholic
      C. Non-Jewish
      D. Non-White
      E. Homosexual

      Since all four criteria would screen out most possibilities, here’s the list of the people that are likely, based strictly on meeting 3 of the 4 above diversity criteria.

      M. Margaret McKeown
      Johnnie B. Rawlinson
      Leah Ward Sears
      Janet Napolitano
      Kathleen Sullivan
      Pamela Karlan

      My guess on the shortlist is:
      Diane Wood
      Johnnie B. Rawlinson
      Leah Ward Sears

    • Rumor has it Leah Sears of Georgia is friends with Clarence Thomas…UGHH, that should rule her out.

      Anyway, the next justice must be further to the left of Sotomayor. They should be young (late forties/early fifties) so that whoever selected would still be on the bench when I’m in my fifties( I’m currently in my twenties). I would like to see another woman selected given that Ruth Ginsburg is recovering from pancreatic cancer and my not stay on much longer as I would like on the court.

      It’s not a rumor, it’s a fact.

      Why should that rule her out? Ruth Bader Ginsburg has a very warm relationship with Anthony Scalia and had a warm relationship with William Rehnquist, and she’s the complete judicial opposite of both of them.

      Just because people happen to be friendly doesn’t mean that they will agree on legal issues. It’s not uncommon for judges on the same bench to be friendly with each-other even though they seldom agree on legal issues.

      She definitely intends to stay on the court, in any case. Ginsburg is old, but she’s tough. She won’t die until she’s good and ready, and she probably won’t retire until she’s ready to die.

    • I don’t believe that Obama has the spine or the desire to nominate a GLBT person to the Supreme Court. He’s already demonstrated multiple times his willingness to ignore GLBT issues to suit his political needs.

      SCOTUS absolutely should get another racial minority non-catholic female, but I don’t trust Sears to be supportive of GLBT equality.

      Where exactly are the gay folk in Obama’s team? I don’t think he has any in a cabinet position.
