Ruby-Sachs: A win in Florida

By Emma Ruby-Sachs, 365gay blogger 11.25.2008 1:05pm EST

This morning a judge in Miami ruled that there is no rational basis for the ban on gay adoptions in Florida. The more times courts say that there is not rational basis for the discrimination against LGBTQ people, the better off we will all be. Keep it as a mantra judges: “No rational basis, no rational basis.”

    • Considering how the states allow crack heads and undesireables to adopt and further traumatize these children, no one can tell me that we cannot provide better stability and security for these kids. hooorayyyyy for FLA

    • It’s coming down the line. . . judges looking at equal protection, civil rights, and rationale of all manner of measures that deny equal rights. Hooray for this most recent judge in Florida having the backbone to tell the voters that they have no basis for these types of discrimination. I hope this gives the California Supreme Court the decisiveness to void Prop. 8 since neither the electorate nor the legislature has the right to vote to deny anyone civil rights even it the vote is 100% in favor of discriminating. If all of the gay married couples that got married in California along with straight friends fund the legal challenges to this measure, I think that they can raise more money than was initially raised for “No on 8″. Hopefully the best attorneys who can articulate the arguement for equal protection, it will give judges no choice but to rule against discriminatory laws or voter initiatives. I must say that I am surprised in the Black community, who were discriminated against for so long, are NOT jumping in to help us with our battle for equality. This country is based on civil rights, not whether or not you personally agree with every issue, especially if it is something they don’t believe that they should participate in for religious reasons. In every battle, may love win. There is far too much pain, suffering, and hatred in this world.
