Man wearing woman’s bathing suit arrested
An Ohio man was arrested Monday evening after allegedly harassing people along the Little Miami River while wearing a women’s bathing suit.
Kevin Lee Miller, 41, didn’t threaten anyone police said; a reporter for WHIO Dayton said he was making people uncomfortable and that people felt “safer” upon his arrest. He was charged with five counts of public indecency and three counts of menacing.
The report, which was picked up by CNN Headline News, seemed to suggest that the man was menacing because he called attention to the fact he was wearing a women’s bathing suit.
Was the reporter biased? See for yourself and let us know what you think in the comments.

Man, that’s just f’d up. How the hell can they arrest someone for what they’re wearing?! He threatened no-one. It wasn’t obscene. Hell Pamela Anderson’s tit’s and cameltoe are more obscene than that! They’re charging him with 5 counts of f’ing NOTHING! Please! Michael Phelps wore a hell of a lot less on national television. (not that I’m complaining… )
Our police are corrupt and our criminal justice system is a lost cause.
See what happens when you only get part of the story? I was leaving work when this was on the 11 O’Clock channel 19 (fondly known as “GhettoAction 19″) news. I thought this was another dude rounded up by the Cleveland Metroparks rangers. Had no idea it was at the other end of the state. Then again, Southwest Ohio is miserably repressed and bible-y, so you kinda expect this.
@Kari – how is it exhibitionism to wear a fully concealing bathing suit (that is actually more concealing than some men’s bathing suits)? He wasn’t naked. The public has no right to not see someone just because that someone fails to conform to their notions of gendered behavior.
I cannot agree with Jonathan’s comment that people cannot wear whatever they want. I have seen more “underwear” that is indecent than a woman’s swimsuit worn by a man. Clothing is clothing, whether it is for a man of a woman is just a suggestion by the designer and manufacturer. This man must have some kind of mental issues and needs help, not arrested for making people uncomfortable. If this is allowed, then I will press charges on parents who do not make good decisions for their children because they make me uncomfortable.
lol, why’s this story on this site? did he identify as gay or trans?
Obviously it’s a BS arrest but this site doesn’t usually report on a BS arrest just ’cause it’s a BS arrest. I don’t get it…
They won’t get away with that. The ACLU will be all over this
Holy…lots of opinions on this one.
I agree that he looks fantastic in that swimsuit. I agree that he’s legally entitled to wear whatever clothes he wants on his own property. He doesn’t have to be a pre-op transsexual to wear women’s clothing.
As for drawing attention to his bathing suit, I guess it depends. If he were saying “Hey, do you like this suit?” or “Doesn’t this colour look good on me?”, then I’d say it’s fine. If he’s going up to people and saying “Hey, look, I’m a man and I’m in a women’s bathing suit.” or “Hey, you can see the outline of my genitals down here, see, I’m a man.” then there might be issues.
Finally, it’s a good thing that the police are protecting the children who are out of school for the summer. Heaven forbid they should learn something about different people during their time off.
So if a women wears a tie, a man’s brimmed hat, with a suit coat, pants, wing tip shoes, a cigarette hanging out of her mouth, and dark sun glasses for that classical stylish look, is she being indecent and menacing to her opposite sex? She should be arrested for such dress. I mean it would scare me to see such a classic look on a woman!
I hope this man makes millions in a law suit against this town for harassment!
Victoria, don’t worry about Jen Cardenas. She’s not being sarcastic, just “curious”. I’ve seen her posts on 365gay.com recently. Which means she actually hangs out on this site quite often, which actually means. . . well, we all know the answer to that one.
She’s actually getting so hot she can’t even spell correctly.
I’m a lesbian and I found myself thinking “would that I could look that good in a swimsuit.” I don’t care who you are, he did that suit justice and put a lot of women to shame. He was by the river in a swimsuit? *gasp* Somebody call the po-lease!!! Kari-”Freedom of expression gives you the right to create and to do, but not the right to bring others into your activity against their own interests by exhibitionism.” I agree with you to a point – but we would never be able to have ANY Pride parades if that was the law. Who gets to define exhibitionism? But again, we don’t have the complete story, so until then…
Jen Cardenas Said: June 9th, 2009 at 9:18 wrote “Thank God someone arrested him…those poor people who had to deal with the man could have made a civil arrest for that indecency. Men wear MEN’S clothing and women wear WEMON’S clothing for a reason. Seriously, people are so ridiculous. Act like the man you were to born to be.”
OK part of me I wants to be believe your post on a site like 365 is some expression of satiric hyperbole, but sadly I am guessing you are in fact just a close-minded, conformist sexist troll.
What constitutes “WEMON’S [sic] clothing” anyway? I mean I can’t think of any type of garment women do not wear or that bears some incredible stigma. Men are the ones with arbitrary limits imposed on them by a homophobic society terrified by men expressing any feminine traits.
WTF does it matter if someone wants to wear whatever they want on their property…i will walk around naked on my property for all i care, i live there, i paid for it, its my land my property…thats some BS FTW F**K Ohio
There’s no way he should have been arrested, based on what was reported. I’m very interested in the follow-up on this story.
Who is to say he wasn’t packing weapons of mass destruction in those cups? He might be the first wave of some new transvestite splinter group. Better get Homeland security involved.
People who are not exposed to other walks of life are naturally disturbed. It’s our duty to inform the public of human diversity. That is the only way to stop this kind of arrest. Unless of course he really was harassing people.
