Man wearing woman’s bathing suit arrested

An Ohio man was arrested Monday evening after allegedly harassing people along the Little Miami River while wearing a women’s bathing suit.

Kevin Lee Miller, 41, didn’t threaten anyone police said; a reporter for WHIO Dayton said he was making people uncomfortable and that people felt “safer” upon his arrest. He was charged with five counts of public indecency and three counts of menacing.

The report, which was picked up by CNN Headline News, seemed to suggest that the man was menacing because he called attention to the fact he was wearing a women’s bathing suit.

Was the reporter biased? See for yourself and let us know what you think in the comments.

    • Thank God someone arrested him…those poor people who had to deal with the man could have made a civil arrest for that indecency. Men wear MEN’S clothing and women wear WEMON’S clothing for a reason. Seriously, people are so ridiculous. Act like the man you were to born to be.

    • It’s ridiculous! By the police officer’s own admission — he was on his own property and didn’t threaten anyone. What a sham. I wrote an email to the general manager and that “reporter”, Brittney McGraw — which you can find on their website. By the way, check out Ms. McGraw’s ultra-religious bio while you’re at it. It’s a hoot.

    • I think it’s more obscene to see some of these whales on the beach wearing “accepted” beachwear.

    • The reporter was a little biased, but not as much as the people they were talking to.

She didn’t need to point out that he was ‘even wearing a bra’. Seriously. We can see. Thanks.

The man is protected under freedom of expression, but he does not have the right to go up to people and deliberately draw attention to himself.

Freedom of expression gives you the right to create and to do, but not the right to bring others into your activity against their own interests by exhibitionism.

    • jonathan, what “nefarious” purpose can be achieved with the use of a bathing suit? are you being sarcastic, because apparently i haven’t been picking up on that very well lately…
i mean i’m not really sure what your argument is…

    • If this guy was harassing people, making a verbal nuisance of himself, or threatening people, the reporter saidhe didn’t) I can understand charges of menacing. But public indecency? What’s that about? He was wearing a bathing suit. If the charge stems from him wearing a woman’s bathing suit, the same charge should be pressed against any and all women wearing the same suit. Equality under the law in all things. If a woman can get away with it, so should a man.
FYI, for anyone who asks about a woman wearing a man’s bathing suit. I feel the same way. Why the world is so hung up on femal nipples being exposed has always baffled me. If men can expose nipples, women certainly should be allowed to.

    • Here is a link to the article:

      http://www.whiotv.com/news/19697272/detail.html

The article says “he was found on his property.” So they are arresting him for dressing the way he chooses on his own private property? Quite frankly, that bathing suit in the video covers MUCH more than I usually see women wearing these days at the beach. I’d sue if I were him.

    • Johnathon: “People cannot just wear whatever, wherever they want – but if he were starting the sex change process, this would be terrible treatment. It does depend on his reason for wearing the suit.”

How is a man in a bathing suit which covers his genitals and buttocks in violation of the law? Most women’s suits have more material than a guys Speedo.

To the best of my knowledge no laws against cross-dressing remain regarding indecent exposure in the US. This sounds like police harassment for simply being non-conformist, whether related to gender-identity or not. I mean charged with “menacing” but didn’t actually threaten anyone…come on.

    • Going on vacation to Hawaii in two weeks, I better make sure my cell phone is fully charged up because I’m going to be making a shit load of phone calls to the police for seeing people wearing one-piece bathing suit for indecency and making me uncomfortable.

    • While I agree with everyone, we are assuming that the man did not have some nefarious purpose in mind. People cannot just wear whatever, wherever they want – but if he were starting the sex change process, this would be terrible treatment. It does depend on his reason for wearing the suit.

    • Rush Limbaugh, Bill O’Reilly, Pat Robertson and a lot of others make me uncomfortable. does this mean i can have them arrested? One can only wish.

  • Alex Said: June 9th, 2009 at 6:36 pm
    • Yeah… unjust arrest anyone? Massive lawsuit for discrimination, perhaps? If making people ‘uncomfortable’ were viable grounds for arrest I’d have been locked away for good, and I haven’t even gone out wearing women’s clothing yet!

  • cm Said: June 9th, 2009 at 6:33 pm
    • So are all the women on the beach going to be arrested for indecency for wearing women’s swim suits? – apparently, they’re indecent!

  • scott Said: June 9th, 2009 at 6:29 pm
    • Please somebody tell me the ACLU is going to defend him!!! Seriously it scares me to live in a country where police officers take these kind of liberties.

  • Randy Said: June 9th, 2009 at 6:28 pm
    • Wow. So now making people “uncomfortable” is a crime, and wearing MORE bathing suit than required is “indecent” and “menacing”. What else do you expect from Ohio?
