Lowenstein: Obama administration argued DADT “rational” policy

The Supreme Court rejected a challenge to Don’t Ask, Don’t Tell today, missing it’s opportunity to overturn the discriminatory policy:

“The Supreme Court on Monday turned down a challenge to the Pentagon policy forbidding gays and lesbians from serving openly in the military, granting a request by the Obama administration.

“The court said it will not hear an appeal from former Army Capt. James Pietrangelo II, who was dismissed under the military’s “don’t ask, don’t tell” policy.

“The federal appeals court in Boston earlier threw out a lawsuit filed by Pietrangelo and 11 other veterans. He was the only member of that group who asked the high court to rule that the Clinton-era policy is unconstitutional.

“In court papers, the administration said the appeals court ruled correctly in this case when it found that “don’t ask, don’t tell” is “rationally related to the government’s legitimate interest in military discipline and cohesion.””

While it’s certainly disappointing that the Supreme Court would choose to let this opportunity to challenge the Constitutionality of Don’t Ask, Don’t Tell pass, the Obama administration’s contribution to the case is even more problematic.

The administration has said all along that it will follow and support the law while it remains legal, and yet their argument– that the policy is “rationally relationed to the government’s legitimate interest in military discipline and cohesion”– seems callous to the extreme.

The complete dearth of leadership on this issue is made only more complicated by the reality that a vast (and growing) majority of Americans want to see the policy overturned. A new poll from Gallup shows that 69% of Americans want to see the policy overturned, an increase of six percent over the last five years. While liberal support for overturning the policy has consistently been high, the most dramatic change is among conservative and church-going voters.

Americans are six percentage points more likely than they were four years ago to favor allowing openly gay men and lesbian women to serve in the military, 69% to 63%. While liberals and Democrats remain the most supportive, the biggest increase in support has been among conservatives and weekly churchgoers — up 12 and 11 percentage points, respectively.

The significant– and diverse– support for ending Don’t Ask, Don’t Tell means that it is time for change. The Obama administration had better wake up and smell the progress on this one, before it becomes even more obvious that they’re playing politics with our national security.

    • Every GLBT service member should come out at once. Only when they actually realize how many service people are GLBT will they get off their asses and repeal DADT. The government wouldn’t be able to run our military at even half strength if this were to happen. I am sure that everybody here would be RAOFLMAO.

    • The Obama Administration, the Supreme Court, and the Pentagon have just weakened our National Security, and in the process, have also betrayed our brave gay military members who are being fired under the cowardly Don’t Ask Don’t Tell policy.

    • We got what we voted for. An unknown who made it clear that he is not for us. His lies about DADT were just more politcal pandering. I hope he knows he can’t count on my vote again.

    • The Supreme Court is supposed to make decisions like this on their own, not be pressured by the current administration. Sounds like our branches are growing inter twined. That only defeats their intended purpose.

    • Only Nixon could go to China, and only a Black Democratic President could screws us as well as Obama has.

      The Democratic Pary needs a bit of a wake-up call. Don’t vote for them, vote against them, even if its, yes, voting against your own interests. You don’t have to do it forever, but at least until the Nancy and Barrack get their heads out of their butts.

    • I just mailed in change of voter registration forms. I’m no longer a democrat. They have become so bloated with power that they are completely ignoring the gay community. They give everyone from Planned Parenthood to Acorn handouts while dumping us in the gutter.

    • I think this response by Gates, appointed by Obama, is clearly is an affirmation of the gay ejection policy, still in place.

      It is humiliating to have supported Obama over Clinton, and now to have to withdraw support from Obama. I don’t won’t support him in any facet, as the democratic party takes my vote for granted. I will vote for a third party at this point. Why can’t Gates simply tell the military prosecutors to temporarily suspend investigations and files? That is simple, and clearly required. But they apparently feel the policy is necessary for military cohesion. Obama lied to me, so that is it.

    • He thinks that by pacifying groups like the HRC he is still going to get our votes. I dont know why the HRC continues to take a backseat issue to everything but workplace discrimination. I used to work for them and I just don’t get them anymore. As George Bush tried to put it, “Fool me once shame on you, fool me twice, shame on me.” I no longer support Obama, I no longer support the HRC.

    • Obama is not a friend to gays and lesbians. He never was and never will be. The sooner we all get that and move on, the better. Ironically, history will probably be quite unkind to him in this respect. A member of a minority group who had no empathy for another one? Kind of makes you wonder what is so historic about his presidency? The form may be different but the substance is sort of the same…especially on the issue of civil rights. Wow. Talk about irony…
