Lawrence King Case Gets Worse

By James Withers, contributing editor, 365Gay Blog 07.25.2008 9:19am EDT

A judge ruled the 14 year old boy accused of killing Lawrence King can be tried as an adult. Brandon McInerney allegedly shot King as the child, who had told friends he was gay, was writing an assignment for his English class. The February crime occurred in a school in Oxnard, California, a state that has what’s called Proposition 21. Passed by California voters in 2000, this law gives state prosecutors more leeway on charging children 14 and older with adult crimes without having the permission of a  judge. McInerney is charged with first-degree murder and a hate crime.

No one reading this site is looking to give McInerney a pass; however, what purpose is served charging the young with adult crimes? California gives death to those found guilty of first degree murder and I’m not sure the state wants to be known for executing a child.

Post Script: It’s clear I’m no legal scholar. As GI pointed out the Supreme Court abolished, in 2005, the death penatly for convicted murderers if the crime was done before they reached 18.

    • My first presntation in Intro to Sociology I spoke to my all stright classmates stealing a bit from Ellen trying to show them that it’s not a crime that one he was honest and shared his feelings and two that he was Gay,neither of those should have warrented his death at the hands of his fellow classmate. Wrecking havoc not only upon his family but that of the child who took his life. In small town Iowa the same feelings sadly still exist a good Gay is a dead Gay. But being a bull headed thick hearted Butch lesbian my next presntation will be to drive the point deeper by speaking on the subject of Hate crimes. Damn the torpedoes away as it were, this is the subject where my passions are strongest.

    • Ahhh, there is hope for California.

If this person is convicted, I can see no reason why he should not be punished to the full extent of the law. I completely agree that such a heinous crime should be tried in an adult court.

And James, am I getting this right? You are actually comparing someone’s sexuality with a capital crime? Please tell me that you are kidding?

    • For whatever reasons, whether by genes, by birth incident, made by parents, or caused by peers, Brandon McInerney was MONSTER and deserves a life of punishment at the very least. He must never again be loosed upon an unsuspecting society, for any reason whatsoever. If he can do this at 14, of what other horrible evils is he capable? We must cleanse the gene pool of people who act like this.

      When is enough ENOUGH?
      NOW IS WHEN!

We do not need any more monsters in this world. We must send a message to parents, children, school administrators, teachers, friends, neighbors and the police that this type of behavior is simply and plainly unacceptable, from anyone, now and in the future, FOR ALL TIMES, FOR ALL SITUATIONS.

We must demand that sanity exist, that the rule of sane laws is required, and that prevention of this kind of evil by ALL responsible parties is demanded.
